| Plans Information Paper 1/2009 ANGUS TITLE PLANS (BROWN EDGES) The specific applications to which this memo refers are Local Authority properties within the County of Angus, where each property has the following right referred to in the text of the deed, "the proprietors of the subjects shall be entitled to park one motor car on any of the laybys within the Estate of which the subjects in this Title fall part, which Estate is shown within the boundary lines coloured black on the plan" which plan, is annexed to the deed. Furthermore there is generally a reference to the Estate in the burdens where it refers to the following, " the purchasers shall be bound to contribute to the cost of maintenance, repair and renewal of the whole footpaths, services, laybys, clothes poles and boundary walls within the Estate shown within the boundary lines coloured black on the plan and the upkeep of the ground and garden areas therein used as common" Various styles have been used, in the past few years, to reference these estates, which are generally shown by a brown edge on the Title/Supplementary Plan,
With these styles have come a number of problems, the Index Map for these areas have become extremely confusing, not to mention the effects on Registers Direct. The extents depicted on the deed plans are not consistent and this causes inconsistency in instruction. Therefore in order to bring uniformity to the mapping style and title sheets, these rights and burdens should be verbalised. Plans settler should instruct Legal to provide a verbal reference.
