Pre-Registration — Common Enquiries and Some Answers

Pre-Registration has compiled a list of issues which they often answer solely by reference to published information, policy or guidance. To assist we have added a link to the guidance.


    1. Using a copy of the Keeper's Title plan.  For the Keeper's policy on copyright.
    2. Transfer of business – lenders and other institutions The Keeper publishes updates and information on past mergers and transfers.
    3. Use of Will as link in Title.
    4. Enforceability of burdens – The Keeper does not indemnify the enforceability of burdens. However unless it is apparent that a burden no longer exists her policy is to include these unless discharged or obsolete in terms of  legislation. See Real Burdens. 
    5. a non domino applications - Pre-Registration is unlikely to be able to confirm that evidence is sufficient but can indicate the evidence likely to be required link to policy.
    6. Removal of Matrimonial Homes qualified note.
    7. Servitudes are overriding interests on the burdened property and rights in the benefited property.  The Keeper has an established policy in regard to whether these can be included.

    10. Questions regarding pending applications. - all should be submitted to the team leader in the district dealing with the application
    11. Requests for voluntary registration – this is solely at the Keeper's discretion and enquiries should be made in writing to Eric Willis, Registers of Scotland, Meadowbank House, 153 London Road, Edinburgh EH8 7AU.
