Pre-Registration — Common Enquiries and Some Answers
Pre-Registration has compiled a list of issues which they often answer solely by reference to published information, policy or guidance. To assist we have added a link to the guidance.
- Using a copy of the Keeper's Title plan. For the Keeper's policy on copyright.
- Transfer of business – lenders and other institutions The Keeper publishes updates and information on past mergers and transfers.
- Use of Will as link in Title.
- Enforceability of burdens – The Keeper does not indemnify the enforceability of burdens. However unless it is apparent that a burden no longer exists her policy is to include these unless discharged or obsolete in terms of legislation. See Real Burdens.
- a non domino applications - Pre-Registration is unlikely to be able to confirm that evidence is sufficient but can indicate the evidence likely to be required link to policy.
- Removal of Matrimonial Homes qualified note.
- Servitudes are overriding interests on the burdened property and rights in the benefited property. The Keeper has an established policy in regard to whether these can be included.

- Questions regarding pending applications. - all should be submitted to the team leader in the district dealing with the application
- Requests for voluntary registration – this is solely at the Keeper's discretion and enquiries should be made in writing to Eric Willis, Registers of Scotland, Meadowbank House, 153 London Road, Edinburgh EH8 7AU.
