Pre-Registration — What We Do
From 10 January 2011 a fee of £50 plus VAT per enquiry will be charged in terms of The Fees in the Registers of Scotland Amendment Order 2010. The invoice will accompany the response to your enquiry.
Pre-Registration will continue to give guidance on current transactions which will shortly be forwarded to the Keeper for registration where anomalies and defects are uncovered during an examination of title. No legal advice will be given; rather the Keeper will restrict her comments to the registration issues involved.
We will not as part of this service, provide advice on applications that have previously been submitted for registration.
Pre-Registration will deal only with the question or questions asked and will not consider titles as a whole. FEES
Only one fee will be charged where an enquiry asks a number of questions relating to one future application or where an agent has identified one issue which involves a number of related applications.
Pre-Registration will indicate whether the Keeper is likely to exclude indemnity in relation to the specific issue if this is appropriate but will not guarantee that a title will be issued without an exclusion of indemnity. This will be done at the time the registration process is completed and the title fully examined.
Pre-Registration will respond to all enquiries within five working days of receipt In order to assist prioritisation the date of settlement should be clearly marked on the enquiry letter.
