Land Register Reports Frequently Asked Questions
Q I am dealing with a transaction that will induce First Registration - what pre-registration Reports are appropriate?
A Form 10, and if exclusive ground is being transferred, a P16. (may be submitted as a Combined Report to attract reduced fee). Near to settlement the Form 10 can be updated with a Form 11.
Q When completing an Application for a Form 10 Report which deed should be referred to in the description box?
A For a single property generally it will be the Split-off writ e.g. the Feu deed by a builder or a council. If the area in question is still part of a larger estate a reference to a title to the larger subjects should be narrated. It does though occasionally help in locating the subjects of the Report to refer to a more recent deed.
Q Will my Form 10 report show exceptions?
A If your request is over the whole subjects in a particular deed and there have been split-off writs since the prescription writ, these will be shown. Possible exceptions to this will be reports over large estates. If the report is requested over subjects being part of a particular deed then exceptions will not be shown. If it is unclear from your application it can be helpful to explain your exact requirements on a paper apart.
Q Can I use a Form 10 Report as a searching tool?
A No. A Form 10 Report is specifically a report over subjects that induce registration in the Land Register. Reference to a deed recorded in the Register of Sasines must be completed on the form for us to be able to process your application. Any requests for a search should be directed to our Customer Services Centre.
Q I am dealing with a transaction that is currently in the course of First Registration - which Report form is appropriate?
A Form 12 - this may be updated near to settlement by a Form 13.
Q Can anyone other than the Keeper issue P16 Reports?
A No. Only the Keeper can issue a P16 Report. Other suppliers offer equivalent comparisons, but when completing question 2 of the Form 1 only an official P16 Report from the Keeper should be referred to.
Q Should I submit the deed plan that the title refers to for a P16 Report?
A All deed plans referred to should be submitted with the application.
Q By which methods can I submit a Report?
A Report requests can be faxed or sent by Royal Mail, DX or LP. Forms 10, 11, 12 and 13 can be completed online and submitted via the Web. All other forms can be accessed via the Web, completed and then printed off. Paper copies of Reports forms can be obtained free of charge. For more information on eforms see the contacts below.
