FEUDAL ABOLITION - STATUTORY FORMS

Background
In terms of Section 5 of the Abolition of Feudal Tenure etc (Scotland) Act 2000, it will no longer be necessary to endorse a Warrant of Registration on a deed presented for recording in the General Register of Sasines after the 28 November 2004 (the appointed day). Instead, there will be a new, statutory Sasine Application Form (SAF) prescribed by Scottish Ministers which must accompany deeds presented for recording.

In addition, amendments to the Land Registration (Scotland) Act 1979 resulting from the Abolition of Feudal Tenure etc (Scotland) Act 2000 and the Title Conditions (Scotland) Act 2003 require minor alterations to the Land Register Forms 1,2 and 3. The revised versions of the forms replace the existing forms from the appointed day.

Sasine Application Form

Transition
The Sasine Application Form does not become statutory until 28 November 2004. However, the Keeper will introduce the form to replace the Computerised Presentment Book (CPB2) from 20 October 2004. This will give customers the opportunity to become familiar with the new Form and allow old stocks of the CPB2 to be withdrawn prior to 28 November.

It should be noted that until 28 November all deeds presented for recording in the Sasine Register will still require the Warrant of Registration to be written or endorsed thereon. An appropriately completed statutory form must accompany any deed presented for recording in the Register of Sasines received after 26 November. And deed presented for recording with a Warrant of Registration but not accompanied by a statutory Form will be returned to the presenting party.

Form Availability
Paper copies of the Sasine Application Form will be available from Registers of Scotland Customer Service Centres from 20 October. In addition, the eforms online CPB2 Form will be replaced by the Sasine Application Form on this day. (A PDF copy can be downloaded from the link below).


Land Register Forms

Transition
The revised versions of the Land Register Forms 1, 2 and 3 replace the existing Forms 1, 2 and 3 from 28 November 2004. Applications received thereafter should be accompanied by the new version of the relevant form.

The new versions of these forms should not be used for applications lodged before 28 November. Likewise, from 28 November, the old versions of the forms should not be used.


Form Availability

Paper copies of the new Forms 1,2 and 3 will be available from Registers of Scotland Customer Service Centres from 1 November. In addition, the eforms online versions of the forms will be available from 26 November. (PDF copies can be downloaded from the links below from 1 November).
