Q. I have a Disposition granted by the survivor of two proprietors who held title subject to a special destination. Will the Keeper need to see the death certificate of the deceased proprietor? 

A. Yes. However, the Keeper will also require satisfactory assurances that the destination was not evacuated by inter vivos or mortis causa deed. If the selling solicitors are able to do so, they may provide a letter confirming that this is the case. If not, the Keeper may accept one or more Affidavits from individuals with the necessary knowledge of the deceased's circumstances. Where the person with the necessary knowledge is the granter of the Disposition, their declaration that the destination was not evacuated may instead be included in gremio of the Disposition.
