GLOSSARY
Absorption
The merging of two fees as in a consolidation of property with superiority or on the termination of a
lease otherwise than by expiry of its natural term (sections 2(1)(a)(iv), 2(4)(a) and 8(2)(b)).
Certificate of Title
Includes a land certificate and a charge certificate (Rule 2)
Certificate Plan
Facsimile of the title plan included in a land certificate
Charge Certificate
A duly authenticated certificate issued to an applicant on the registration of a heritable security
(section 5(3)).
Commencement Date
The appointed day on which an area becomes operational (section 30(2)). See para 1.8.
Dealing
Any transaction which on registration causes an amendment to be made to the title sheet of a
registered interest in land (section 5(1)).
Dealing with the whole
A dealing with the whole of a registered interest. Paradoxically, this expression includes a dealing
with a part of a registered interest in respect of which the Keeper does not require to make up a
separate title sheet (section 5(1)).
Deed inducing Registration
The deed which is the immediate cause of a first registration in the Land Register.
First Registration
The registration in the Land Register of a previously unregistered interest in land (section 6(1)).
Indemnity
Provision is made in the Act for a person who suffers loss in certain circumstances to be
indemnified by the Keeper to the extent of that loss (section 12).
Index Map
Consists of a series of ordnance maps held by the Keeper and on which are delineated by him properties
in respect of which interests are registered (rule 23)(a)).
Interest in land
Any estate, interest, servitude or other heritable right in or over land including a heritable security but
excluding a lease which is not a long lease (section 28).
