Arrange site visit to compare extent in
prior titles and the Ordnance Map with
the development on the ground
Three main possible outcomes of site
visit
Legal extent depicted in prior titles is
greater than occupied extent.
Legal extent depicted in prior titles agrees
with occupied extent on the ground. Therefore
the Ordnance Map is incorrect.
No further action required other than to
confirm findings to Keeper with application
for registration by answering Question 2 on
Application for First Registration Form 1 as follows:
(Note: a covering letter may be included
with the application if desired).
As the Keeper has issued a P16 Answer 3 which
states that the boundaries do not coincide with
those on the Ordnance Map you should answer
the first part of Question 2 No.
As the site visit has confirmed that the legal
extent depicted in the prior titles agrees with
the occupied extent, you should answer the
second part of Question 2 YES.

lesser occupied extent?
Is the applicant willing to accept the
lesser legal extent?
Inform Keeper of intention with
Application for Registration by
answering YES to Part (b) of
Question 2 on the Application
for Registration Form 1.
Ensure Keeper is informed of
intention to seek registration
of legal extent and any action
to resolve matters.
I draw your attention to Question 3 on the Form 1
Application for First Registration concerning
adverse possession or occupation and would
advise you to disclose as much information as
possible as to the situation on the ground (age
and nature of boundary features, occupation and
usage of area in question).
Confirm intention to Keeper in writing
with Application for Registration
It is important to supply the Keeper with as
much information as possible as to the
situation on the ground. This should include
the age and nature of boundary features (e.g.
Ranch style fence 10 yrs old/hedge 15 yrs
old) and the occupation and usage of the
area (e.g. non maintained scrub
ground/garden ground maintained by).
Remedial conveyancing may be required and
should be completed prior to Application for
Registration. If you have any problems

the Keepers position.
