Sasine application form

This guidance provides step-by-step instructions on how to complete each part of the sasine application form.

Use of the sasine application form is a statutory requirement. You must complete a separate form for each deed to be recorded in the sasine register, and each must be completed fully and accurately.

Don’t staple or pin any documents to the application form. You should ensure the form is not torn, crumpled or excessively folded.

Presenting agent

Name and address

Enter the full name and address of the presenting agent.

If you’re a not legally qualified person such as a solicitor or licensed conveyancer, you’ll need to complete an identification form (PDF, 174KB) along with your application. The identification form process helps us protect against fraud, as the checks that a legally qualified person would normally carry out when acting for a client will not have been undertaken.

FAS number

Enter the presenting agent’s four-digit FAS number.

This is the number allocated to solicitors by our financial accounting system for the payment of fees. If the presenting agent has FAS numbers relating to both cheque and direct debit payment types, add the appropriate number for the payment method used.

Agent's reference

Enter a reference through which the application may be identified. We’ll use this reference in correspondence.

Agent's telephone number

Enter the full telephone number of the presenting agent, including area code.

Agent's email address

Enter the email address of the presenting agent. In eforms, this field is pre-populated with the account holders email address.

Counties

Select the county or counties in which you want to record the deed. The deed will only be recorded in the counties specified.

Deed details

Deed type

Select the type of deed to be recorded.

Preservation and execution

Confirm whether the deed should be registered for preservation, or preservation and execution.

Registration for preservation means we’ll retain the deed for safe keeping. After we register the deed, we will send you an extract that you can use in the place of the original.

If your deed contains a clause where the parties consent to ‘registration for preservation and execution’, your extract will contain a warrant that grants authority for lawful execution. This extract will be equivalent to a decree from the Court of Session, and can be used as the basis for summary diligence in certain scenarios.

Number of extracts

Enter the number of extracts required if you desire preservation or preservation and execution.

Granters

Enter the full name and address of each granter as it appears in the deed.

The sasine application form has space for two granters in the first instance. You can add more granters by clicking ‘add another granter’. When using the PDF version of the form, mark an X in the box above Granter 1 and include any additional granters on the additional granters sasine application form.

Enter the names and addresses of trustees or partners of a firm as you would individuals. Add the name and address of the firm in the appropriate field.

Where the granter is acting in an executory capacity, enter the name and address of each executor along with the capacity in which they are acting. For example:

Surname: CAMPBELL

Forename(s): ROBERT GORDON (Executor)

Where the granter is acting in a fiduciary or other capacity, enter the name and address of the party along with the capacity in which they are acting. For example:

Surname: CAMPBELL

Forename(s): ROBERT GORDON (Trustee)

This applies when the relationship results from a deed of trust, testamentary deed or court appointment.

Where the granters are trustees of a club, include the club’s name and address in the 'firm, company, council etc' field. The names of ex officio trustees should not be inserted.

Applicants

Enter the full name and address of each applicant as it appears in the deed.

The sasine application form has space for two applicants in the first instance. You can add more spaces by clicking ‘add another applicant’. When using the PDF version of the form, mark an X in the box above applicant 1 and include any additional applicants on the additional applicants sasine application form.

Enter the names and addresses of trustees or partners of a firm as you would an individual. Add the name and address of the firm in the appropriate field.

If the applicant is acting in an executory capacity, note the name and ad of each executor, along with the capacity in which they are acting. For example:

Surname: CAMPBELL

Forename(s): ROBERT GORDON (Executor)

An application cannot be submitted on behalf of a deceased party only.

Where the deed is an agreement among parties, all parties should be included as applicants.

If the applicant is acting in a fiduciary or other capacity, enter the name and address of each party, along with the capacity in which they are acting. For example:

Surname: CAMPBELL

Forename(s): ROBERT GORDON (Trustee)

This applies when the relationship results from a deed of trust, testamentary deed or court appointment.

Insert the name and address of companies and councils in the space for ‘firm, company, council, etc’.

Subjects

Insert the full postal address, including postcodes, of all the subjects against which the application should be recorded. Please ensure the correct information is entered in each box.

For example: Flat A, ‘Hill Court’, 53 Eastside, Kirkintilloch, Glasgow G66 1GH, would be inserted as:

House No/Name Flat A, HILL COURT, 53
Street Name & Town/City Eastside, Kirkintilloch, Glasgow
Postcode G66 1GH

To help us identify the subjects, please provide as full a description as is possible.

The sasine application form has room for two subjects in the first instance. You can add more subjects using the ‘add another subject" button in eforms. On the PDF version of the form, mark an X in the box for more than two subjects and insert the additional subject details using the 'additional subjects form '.

Consideration

Insert the consideration in figures. Do not include a pound sign (£).

Please abbreviate non-monetary considerations to fit the box. For example, love, favour and affection may be shortened to LF&A  .

Value

If the consideration is less than the true value of the subjects, or is not expressed in monetary terms, insert the true value here. Do not include a pound sign (£).

Fee and payment

Insert the fee due as determined by the Registers of Scotland (Fees) Order 2014. Our eforms system includes a built in fee calculator to assist with this step.

Payment method

Enter the method of payment – either cheque or direct debit.

Payment additional information

Include any additional information relating to payment.

Search sheet numbers

Enter any search sheet information. If more than three search sheets are affected and you’re using the PDF form, use the additional information space on page 3 of the form.

Search sheet numbers may have been added to the backing of previously recorded deeds.

Dual registration

It is necessary when creating valid real burdens to register the constitutive deed (the deed creating the real burdens) against both the property which will be subject to the real burden (the burdened property) and the property with the right to enforce the real burden (the benefited property). This is known as dual registration. If either the burdened or benefited property is registered in the land register, the title number(s) should be entered in this space.

Certification

Ensure that the application form is signed and correctly dated before submission.
