General application checklist

Drafting and signing

When reviewing your application, check that:

  • the deed has been drafted correctly with narrative, operative clause (in the present tense), and testing clause
  • the deed has been signed correctly, ensure that any individuals acting in a particular capacity (such as director of a company) are narrated in the deed as doing so, and any witness is fully named and designed
  • the deed is signed on the last page of the deed which includes operative text
  • if an attorney signs a deed, they must be named in the testing clause
  • the deeds affecting registered titles refer to a title number
  • the standard securities must be in the form set out in Schedule 2 of the 1970 Act and must refer to standard conditions in Schedule 3 of said Act.
  • the parties to the deed are fully designated

Additional application requirements

Check that:

  • the information in the application form matches the information in the deed to be registered
  • the LBTT requirements are met

Plans and schedules

Ensure that:

  • the plans or schedules annexed to the deed are properly incorporated
  • the plans or descriptions included in the deed are sufficient to allow the extent and/or references for burdens/servitudes to be mapped
  • the plans or schedules annexed to the deed are referred to in the deed and signed by the granters

Application form and digital submission

When using the application forms and digital submissions check that:

  • the correct application type and land register application form are used
  • the deed uploaded via the digital submission service is the correct deed
  • all related deeds and applications are submitted within the same digital submission.
  • uploaded deeds and supporting documents are clear and legible
  • SAF forms, if required, are included (either for joint recording or for the purpose of dual registration of any new servitudes/real burdens)
  • SAF forms are not submitted as supporting documents

Other pre-registration checks

  • For discharges, ensure you check ScotLIS to confirm which register the property is in.
  • For Advance Notices submitted to the Sasine register, remember to include a Sasine reference. E.g. . disp by A – B recorded GRS, county, and date xx-xx-xx.
